Sanjeev Nanda : hit-and-run case in BMW

Sanjeev Nanda, vnuka of former Naval Chief SM Nanda, was sentenced on Tuesday by Delhi court for mowing down six persons in nine-age BMW hit and run case and could face a ten years of imprisonment sentence.
"Sanjeev Nanda, I love you guilty under Section 304 (Part II) (culpable homicide not amounting to murder) of IPC," Additional Sessions Judge Vinod Kumar said in court packed.
Quantum of punishment will be decided on Wednesday.

The court also sentenced three other - businessman Rajeev Gupta and two assistants Bhola Nath and Shyam Singh - to destroy evidence, they are washed spots of blood and victims of meat cuts from irregular vehicle.
Nanda, 30, was found as a driver down six persons including three policemen in the wee hours on 10 - January 1999 in Lodhi colony in South Delhi.
Manik Kapoor, a friend of Nanda, who was in the vehicle during the accident, was acquitted."Nanda and others, the prisoners must be taken into custody," the Court ordered, leaving Nanda father Suresh Nanda, mother and his grandmother's objections in tears.
Previously, Delhi High Court has imposed the ban four months for a senior lawyer RK Anand and IU Khan colleague to intervene in the judicial process in this high profile case.
Section 304 (Part II) of the IPC, applied in the case where the defendant commits an act with knowledge that is likely to cause death but without intention to cause death. The provision stipulates a maximum prison sentence of 10 years or fine or both, as punishment.
Nanda, sports vermilion on his forehead, entered the court around 12.15 am with his grandmother, Gyatri Nanda, father and sister Sonali to participate in a key matter of judgment day.
His family members were left shocked by the court pronounced him guilty under the provision of criminal law, which carries a maximum penalty of 10 years.
Welled tears in the eyes of Nanda relatives and well wishers, as soon as the judge delivered his sentence.
Nanda of supporters also tried to console him.
His family, however, declined to comment on the conviction and looked in disbelief, as Nanda, who was a guarantee to Tuesday, was taken into custody by the police to be taken to Tihar prison van.
On the contrary, the prosecutor Rajeev Mohan expressed satisfaction with the outcome of the case, which hinged on circumstantial evidence.
Since most of them, two eye witnesses, including the only survivor of the incident Manoj Malik, had turned hostile and claimed that it was not a car, a truck that had caused the accident.

Chronology of events

Here is a chronology of the events in the BMW hit and run case:

  • 10 - January 1999: six people, including three policemen, slain by the speed of the BMW car allegedly driven by Nanda in the early hours in Lodhi colony.

  • 14 - May 2007: Kulkarni records declaration court witnesses. It identifies Nanda as one of the occupants of the car, but says he did not see Nanda of the seat.
  • May 30, 2007: A news channel airs a show holidaymakers operation secret agreements between Nanda of the consultant, RC Anand, and the prosecutor IU Khan of undermining the administration of justice.
  • May 31, 2007: Khan would withdraw as prosecutor. Delhi High Court, meanwhile issues contempt notices to both lawyers, after officially joins the awareness of tourists.
  • 7 - my December 2007: Defense begins examining witnesses.
  • August, 1, 2008: The prosecution concluded final arguments.
  • August 20, 2008: Defense closes the progress of final arguments.
  • 21 -August 2008: HC Khan and Anand held guilty of contempt and bars to appear before the court for 4 months.
  • 26 - August 2008: Additional Sessions Judge Vinod Kumar reserves judgement and be set for delivery on 2 september.
  • 29 - August 2008: Nanda claims innocence and gives top court rulings in his support.
  • 2 September, 2008: Court condemns Sanjeev Nanda for the mowing of six persons. Three others, including the businessman Rajeev Gupta, who was convicted for destroying evidence. Another co-accused acquitted Manik Kapoor.
